When you provide us with your Personal Data (hereinafter, Data) we understand that you are aware of and accept the conditions established for the processing of your Data in accordance with this Privacy Policy and Notice (hereinafter, the Notice) in which we inform you, in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter, the Law) and its Regulations (hereinafter, the Regulations), about how and for what purposes we treat your personal information, so we recommend that you carefully read this Notice.
The terms contained herein apply to information that is collected on behalf of and by the Controller or any of its affiliates or subsidiaries, by any means, including through or on any website operated by the Controller.
In accordance with the provisions of the Law and its Regulations, we inform you of the following considerations:
Responsible
The Data Controller responsible for the processing of your Personal Data is BOTWARE, S.A.P.I. de C.V. (hereinafter Botware), whom you can contact at any time via e-mail: b@botwareventures.com.
Purposes
The Data requested from you are processed with the aim of fulfilling the following Purposes (hereinafter, the Purposes): (i) to verify your identity and Contact Data; (ii) for the individualisation of the commercial relationship to be generated between the holder with the responsible party and to specify the general conditions accepted between the parties; iii) to provide, maintain and improve our services, including, for example, to facilitate payments, collections, send receipts and/or invoices, provide products and services (and send related information), develop new functions and improvements to our processes, provide customer service, develop security functions, verify the identity of our customers and send product updates and administrative messages; iv) to properly provide the services and offer the products that Botware offers; v) to perform studies and database analysis aimed at providing feedback and improving our services; vi) to perform internal operations, including, for example, to prevent fraud and abuse of our value proposition; v) to be used for commercial and promotional purposes; vii) to send information to our customers in order to provide them with information about our products and services; viii) to send them information about our products and services; viii) to send them information about our products and services; vii) for sending commercial and advertising information, including by e-mail or other electronic, printed or other means of communication that may be developed; viii) for purposes other than those that are compatible or analogous to those set out in this Notice, without being required to obtain the consent of the Data Controller again.
Additionally, we inform you that, in the event that no commercial act is carried out with you, your Data may be stored and used for marketing purposes, so that we can send you information related to our services or products, invite you to events that we may consider of interest to you, as well as to share with you offers and promotions of our business.
Your Data may be kept for the time considered necessary in order to comply with the obligations of the data controller with legal provisions such as tax, commercial or any other corresponding provisions.
Data obtained
We collect your Personal Data directly or indirectly when you request information, quotes or services; as well as through our website. Similarly, the data obtained in the use of our solutions will be governed by the provisions of the terms of service and by the provisions of this Privacy Notice.
The data we obtain by this means may be: i) Identification data; ii) Contact data; iii) Financial or patrimonial data; iv) Commercial data; and v) Employment data and any other relevant data.
Data protection
Botware declares that it is its objective to provide sufficient protection of the Personal Data of its customers or users, therefore, administrative, technical and physical security measures will be carried out to prevent its loss, alteration, destruction, use, access or improper disclosure.
ARCO Rights
At any time, the owner of the Personal Data may exercise the rights of access, rectification, cancellation or opposition (hereinafter ARCO RIGHTS) and revoke their consent to the processing of their Data by by submitting a request at Rio Manzanares exterior number 427, colonia Del Valle, San Pedro Garza García, Nuevo León, C.P. 66220, or by electronic means as set out below to: b@botwareventures.com.
You must submit an application which must contain at least: (a) your full name; (b) indicate whether the request is submitted in person or through your representative (for which in your case, you must submit a broad power of attorney fulfilled and sufficient for the exercise of the action), (c) your address, (d) your telephone number;(e) indicate whether you accept that the notifications we make in relation to your request take effect through the email you provide us with; (f) a clear and precise description of the Data in respect of which you are requesting to exercise any of the ARCO rights, (g) if applicable, your express declaration to revoke your consent to the processing of your Data; (h) any other element that facilitates the location of your Data (date on which the Data was provided to us, identification number of the event held, person who attended you, areas involved) and (i) the documents that accredit your identity and/or personality or that of your legal representative.
When submitting electronic requests for ARCO rights or if you reside outside the metropolitan area of the city of Monterrey, N.L., Mexico, you may submit the request electronically by attaching a digitalised copy of your official identification and/or power of attorney, as well as the request described above and wait for news about the procedure.
In the case of requests for rectification, you must attach the documents accrediting the request and the specific Data you wish to modify. These documents must be submitted in original and a copy for collation.
The rest of the procedure will be processed in accordance with the deadlines and stages established in the Law.

Consent
Likewise, we inform you that your Personal Data may be transferred to third parties and may be shared with persons in charge of its processing inside and outside the country, by persons other than the Controller, who will issue the instructions for its processing. In this regard, your information may be transferred or shared with (i) various professionals, technicians and assistants, as well as other private entities for subrogated services in relation to customer service; (ii) administrators of loyalty programs; (iii) business partners of the Controller, in order for them to manage and operate complementary services to those of the Controller; (iv) companies or third parties that jointly operate with the Controller any product, service or any software or IT infrastructure that serves as a platform for the performance of operations or services; (v) Third party service providers or sellers of products necessary for the operation of the Controller, as well as commission agents that carry out operations or provide services to the Controller that the latter may perform in accordance with the legislation in force and its articles of association, such as, among others, commission agents, data processors, companies that send marketing material, courier companies, security companies, transport of securities, advertising agencies, information storage, with the purpose of assisting them in the performance of the Purposes set forth in this Privacy Notice; (vi) External professionals, advisors or consultants, for the purpose of administering sales operations, services and other acts that the responsible party may carry out in accordance with current legislation and its articles of association, as well as for the defence of its interests in the event of any legal controversy arising from such operations and services, such as collection agencies, external auditors, legal, accounting, etc.(vii) All those governmental and/or judicial agencies that, by operation of law, request and/or require Personal Data of their clients and/or family members from the Data Controller, necessary for compliance with various legislations. If you do not express your opposition to the transfer of your Personal Data, it will be understood that you have given your consent to do so. In any case, all handling of Personal Data will be carried out in compliance with the Federal Law for the Protection of Personal Data in Possession of Private Parties (hereinafter the “Law”) and its Regulations.
The information you provide must be truthful and complete. Therefore, you are responsible for the veracity of the Data provided and in no case shall the Data Controller be liable in this regard.
Complaints and denunciations
If the holder of the rights could consider that his or her right to the protection of personal data has been violated at any time by any conduct of our manager or employees; or if he or she presumes that in the processing of his or her data there is any violation of the provisions of the Law, he or she may file the corresponding complaint or denunciation before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), for further information please visit the page www.ifai.org.mx.
